The following terms and conditions regulate the access and use of www.motorvista.es, property of Motorvista C.B., based at Avenida Roces Local 2, Gijón, Asturias, 33209, Spain with Tax Identification Number E33995150, hereinafter, "the Company".
The user of the website must read and accept these conditions to use all the services and information provided on the website. The access and/or use of the website, all or part of its contents and/or services means full acceptance of these general conditions of use.
Intellectual and industrial property
All content, brands, logos, drawings, documentation, computer programs or any other element susceptible to protection by the legislation of intellectual or industrial property, which are accessible on the website correspond exclusively to the company or its legitimate owners and are expressly reserved all the rights over them. The creation of hypertext links (links) to any integral element of the web pages of the website without the authorization of the company is expressly prohibited, provided they are not a web page that does not require identification or authentication for access, or the same is restricted.
The images and descriptions of the products have been supplied by suppliers, manufacturers, publications, publicists, or been gathered from public-domain sources. The intention of Motorvista is that all information on the website should be as accurate and up to date as possible. The file of each product indicates if it is in stock or not. A product marked "out of stock" or "back order" or "supplied on demand" or similar will have a delay of about 7 business days. We will ship the order when it is complete / all products are available. We will communicate any additional delay to the customer who has the right to cancel the order at any time with a full refund of the amount paid, if the order has not been dispatched.
All prices published on the website include spanish IVA (currently 21%).
Customers outside the EU (and Canary Islands / Ceuta / Melilla) can purchase without paying IVA, once registered in the store.
Motorvista reserves the right to cancel orders if it detects that a price published on the website has a typographical error. The price of the product does not include shipping costs: details of the shipping options.
Motorvista offers the contractual guarantee that is usually granted by the brand or supplier under the legally established terms, for a period of two years from the date of delivery. Section 5 of Article 123 of the "Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios" recognizes that "The consumer and user must inform the seller of the lack of conformity within two months of having knowledge of it". In the case of a defective product, Motorvista will assume the cost of collection/replacement during the period of validity of the contractual guarantee.
The Purchase Process
In the page of the required product, click on "Add to Cart" to add the chosen product to the cart. There is a link that shows the quantity of products in the cart and the total amount. You can click on this link to see the details of the contents of the cart and the shipping options available (and their cost).
You can finalize your purchase by clicking on "Checkout".
To continue the purchase process, you must register your personal details (if you are a new customer) or enter your account with your email and password (if you are already a customer).
First step: Choose the shipping option.
We ship by SEUR courier and Correos. More details of the shipping options.
Second step: Choose the payment option.
You can pay by bank transfer/deposit, cash on delivery, credit card or PayPal. More details of the payment options.
Third step: Confirmation of the order.
The customer will receive an automatic email confirmation of the order, normally within a few minutes. If the email is not received, the client should check the spam folder/filters before contacting us to resolve any doubt.
The customer has the right to cancel the order at any time with a full refund of the amount paid, while the order has not been sent.
Cancellation of an Order
The order may be cancelled by telephone or email.
If the order has not been dispatched, Motorvista will refund in full the total amount paid.
If that the order has already been sent, Motorvista will refund the amount paid minus the shipping cost and the package pick-up cost.
In the case of orders in which payment has already been made, the corresponding refund will be made within 7 days.
The shipping costs are not included in the price of the items but we offer free shipping in Spain (not Ceuta / Melilla) and Portugal for orders with a value greater than 200€.
Products that are in stock may take 2-3 working days to be processed/shipped as we do not ship every day.
A product marked "without stock" or "back order" will have a delay of about 7 working days before dispatch, as indicated in the product description, while it is delivered from the supplier.
The delivery time depends on the availability of the products selected by the customer.
Once the product has been added to the cart, a table of shipping options is shown on the cart page.
Peninsula - SEUR/Correos
SEUR Service 24 - € 5 (up to 5kg). Delivery within two working days before 7:00 p.m.
You can pick up the shipment at a SEUR office / agency, if it is more convenient for you. At the time of placing the order, you can indicate in the comments which office is most convenient.
Balearics - SEUR/Correos
SEUR Service 24 - 6 € (up to 2kg). The price may increase in relation to the weight and volume of the
Delivery within three working days. You can pick up the shipment at a SEUR office / agency, if it is more convenient for you. At the time of placing the order, you can indicate in the comments which office is most convenient.
Canary Islands - Correos
For items sent to the Canary Islands, IVA is not applied to the purchase. Customers must pay the local Canarian Tax (IGIC) and assume the cost of the DUA of Importation upon receipt of the order in cases where it is applied according to the Canarian tax legislation. The importation can be processed by Correos or by the client. Motorvista is not responsible for costs associated with importation (taxes, tariffs or customs clearance charges), said expenses are always borne by the customer.
Ceuta / Melilla - Correos
Orders sent to Ceuta and Melilla do not have IVA on the purchase and must be accompanied by a DUA to document the
export. It is compulsory for us to raise a DUA for the export to allow us to invoice without IVA,
and to facilitate the import procedures in the destination country. The generation of a DUA adds an additional cost,
this is added to the price of the shipping during the purchase process.
Cost DUA Ceuta / Melilla: 15 euros
Shipments outside Spain/Portugal (within the EU) - Correos
The shipping price varies greatly between countries and in relation to the weight. The final price is always displayed in the cart. Delivery time 7-10 business days.
Note that in the case of a delayed delivery, we cannot instigate a claim with Correos for further investigation until 21 days have elapsed from the date of dispatch. In most cases, the delay is due to the local postal office/service not notifying the customer. The customer should enquire in their local office.
International Shipments outside the EU - Correos
The shipping price varies greatly between countries and in relation to the weight. The final price is always
displayed in the cart. Items that are sent outside the EU do not have IVA on the purchase and must be
accompanied by an export DUA to document the export from the EU. It is compulsory to raise a DUA
for the export to allow us to invoice without IVA, and to facilitate the import procedures in the destination country.
The generation of a DUA adds an additional cost, this is added to the price of the shipping during the purchase
Cost of export DUA countries outside the EU: 20 euros

South America - Correos "Superficie Económico" service
In theory it should take between 1-2 months but in practice it takes between 14-21 days as small packages usually go by plane instead of by sea.
Delivery of Damaged Products
In the case of receiving a package with signs of having been manipulated/opened/damaged, this should be noted on the delivery note of the delivery service. The package should be opened, and the contents checked in the presence of the delivery service. Do not sign the delivery note without having detailed any doubts even if the material seems to be in perfect conditions.

Returns of Defective / Incorrect Products
Motorvista will be responsible for the shipping costs provided that the consumer reports the incidence within seven (7) days from the date of reception of the order.
Returns by Customer's decision
The customer can return a product within a period of 14 days from the date of delivery of the order.
All product returns are subject to approval according to the following phases.
First Phase - Communication
The client must identify the following:
1. The reason for the return (clearly and precisely).
2. Identify the invoice and / or order number that relates to the product in question.
Second Phase - Shipping / Collection
The package subject to a return must be labelled adequately and legibly.
The client is responsible for ensuring that the following is fulfilled:
1. Correct packaging (adequate protection against bumps, humidity, static, dust, excessive heat, theft, loss, etc.).
It is important that you do not put tape directly on the product's packaging.
2. Cost of shipping freight to our facilities at Avenida Roces 1140 Local 2, Gijón, 33209, Asturias, Spain. Motorvista can take care of the collection (for having a better courier rate) according to previous agreement, subtracting the cost from the amount of the final return.
3. Apart from any legal problem, accident, security or any other aspect that might arise from sending the return, this expense will be borne by the customer.
Third phase - Inspection
Once the product arrives at our facilities, the product will be reviewed. The product must be in perfect condition, with all the labels attached, in its original packaging and with the original manuals and accessories. If the product was shipped sealed in an original pack and has been unsealed, Motorvista may refuse to refund the full value of the product. We reserve the right to carry out a devaluation of the product of up to 20% because of breakage or damage to the original packaging, added to the cost of returning the product to the customer. In case of damaged or missing components, these will be charged to the customer, issuing the corresponding invoice to generate the charge. In the case of documents that the client has, as guarantee of payment of the returned products, these will be delivered once the previous process is concluded.
A returned product will not be accepted if:
1. The packaging or product boxes have non-original labels or are violated.
2. That the product is scratched, is dirty, has evidence of having been installed/used or with any form of mistreatment.
3. The packaging or boxes are not original.
4. If the product shows any symptoms of having been used outside the use that is considered normal.
Once the merchandise has been received in our warehouse, and after checking the status of the merchandise, the amount will be refunded as agreed with the customer. Motorvista reserves the right to make the refund by the method most convenient for Motorvista, within a maximum period of 7 days. In any case, the exchange of products in poor condition and due to erroneous shipments will be admitted, with Motorvista taking charge of the shipping costs whenever the consumer indicates this circumstance within seven (7) days from the date of receipt of the purchase.
Bank Transfer/Direct deposit
The customer may pay directly into one of our bank accounts (Banco Sabadell / Banco Santander), using the shop order number as reference to identify the payment, otherwise shipping of the order may be delayed. The customer should inform us by email of the payment to expedite the order processing. This payment method does incur any surcharge.
Cash on delivery – "Contra Reembolso"
We offer cash on delivery for shipments within Spain and Portugal with a value of less than € 400.
This type of payment has a surcharge of 3% of the total amount, with a minimum of € 3, to cover the additional charge levied by the courier for collecting and managing the payment.
Motorvista uses the secure payment gateway of Banco Santander bank (Redsys).
During the purchase process, once the shipping and payment method has been selected, the customer's browser will be redirected to the payment gateway, outside the store's website for security reasons (the store does not save or handle any credit card data). The payment process on the gateway may include an additional security step (password / SMS / card of coordinates) which is defined by the customer's own bank.
Motorvista has no control over the process of collecting the card data or processing the payment. This payment method does not incur any surcharge.
The PayPal payment gateway offers the option to pay using a PayPal account or using any credit / debit card. It is possible that a card that fails with Santander/Redsys, may work with the PayPal gateway.
This form of payment incurs a surcharge of 3% for purchases in Spain to offset the charges levied by PayPal for processing payments. This surcharge does not apply in the case of purchases made from outside Spain.
User Obligations for Use of the website
The user must respect the terms and conditions established in these general conditions of use of the website. Expressly, the user states that she/he will use the website diligently and assume any liability that may arise from the breach of the rules.
